General Conditions of Purchase

The Web Site offers the service of on-line purchase, which means a 24h. service, simple, direct and with all the advantages of having a wide catalog of products updated and available from any place through an Internet connection.

  1. General

All prices are in Euros and in accordance with current regulations, all purchases made through the Website will be subject to Value Added Tax (VAT), and this amount is included in the price.

Orders destined for the Canary Islands, Ceuta and Melilla are exempt from VAT pursuant to the provisions of Article 146 of Directive 2006/112, without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of them. Only direct orders will be served from the on-line store within the national peninsular territory and Balearic Islands. Users residing in other areas who are interested in some of the products offered, should contact us in advance using the contact form or by telephone.

The Holder reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of purchase or unless there is a manifest typographical error.

The Holder reserves the right to refuse an order from any User with whom it has a dispute or there have been problems in the payment of previous purchases.

  1. User Obligations

Any User who makes a purchase through this Website declares to be of legal age and, if applicable, with full capacity to use means of payment and that they have sufficient funds to cover all costs resulting from the purchase of products, the User also declares to fully and unreservedly accept all conditions of this Legal Notice.

Before placing any order, it is the User’s obligation to register in advance on the Website. The User may establish one or more purchase requests for products or services offered through the Website.

By placing an order, the User accepts the specifications and characteristics of the product offered, to this effect the Holder indicates that the products shown in the photographs of this Web Site may suffer slight differences with respect to the final product in terms of size, color, components, etc.. by availability of manufacturers. The purpose of the photographs will be the orientation for the User or suggestions of presentation, without supposing in no case contractual images. The Holder assures in any case that these differences will not imply a worse quality of the products.

  1. Terms and conditions of shipment

All orders placed within mainland Spain and the Balearic Islands will be sent by courier and will be delivered within 72 working hours by FYM CUYPLANHOR S.L. (Tourline Express).

There is no minimum order requirement.

No orders are handled or delivered on weekends and holidays.

The shipping costs for the peninsula are 6,60 €. On orders over 100 € will be free for both the Peninsula and the Balearic Islands.

Additional transportation costs caused by the declaration of an incorrect or incomplete address are the sole responsibility of the User.

  1. Payment Methods and Security

For the User’s convenience, we provide different ways to make the payment:

  • 1) Bank Transfer: Once the order is placed, the bank details are provided to make the deposit or transfer for the amount of the purchase made, and the personal data of name, surname and identity document must be indicated. Only deposits in Euros will be accepted. The order will be processed once the amount has been received in the account. With this payment method no commission is paid.
  • 2) Credit card: This payment method is immediate, totally secure and verified by Redsýs secure servers. In no case will the credit card information be disclosed: Visa and Master Card. Only secured credit cards will be accepted to avoid any possible risk or fraud. The secured cards have security codes associated with them and, at the end of the payment, they are transferred to the bank’s payment gateway, where these codes must be entered. If you do not have a secured card for online payments, the bank must provide the necessary information and passwords.
  • 3) PayPal: Secure payment solution that allows buyers and businesses to send and receive money online. By selecting this method at the time of finalizing the order, the User will directly access the PayPal Website. You do not need to enter bank details, you only need to have a PayPal account created and you can make payments by entering only your email and password, you can also create the account on the spot or make the payment directly by entering your credit card details.   1. Warranties

5.1 Warranty for breakage and other incidents

Shipments are insured in case of breakage, damage, loss, etc.

Once the product has been received, the User must check it immediately to verify that it is complete, that no element is missing and that nothing is broken, since the User has 24 hours from receipt to claim any type of incident. There are no exceptions due to insurance requirements.

In the event of any incident, the User must send an email to tienda@tiendavinosiberian.com containing the following information: order number, comment on the problem and photographs of the broken or damaged item or part. Photographs are essential to verify the veracity of the incident. Telephone communication will not be valid.

Once the incident has been verified and accepted, they will contact the User to indicate the steps to follow. In these cases the User will not be responsible for the expenses derived from the resolution of the incident once it has been recognized.

  1. Right of withdrawal

In compliance with Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, information is provided on the User’s right of withdrawal.

6.1 When the User is a consumer and the contract is concluded without the simultaneous physical presence of the User and the Holder (distance selling), the User shall enjoy the right of withdrawal described in this section, with the exceptions provided for in article 103.

6.2 Information to the consumer and user on the right of withdrawal.

  1. The User has the right to withdraw from this contract within 14 calendar days without giving any reason.
  2. The withdrawal period shall expire after 14 calendar days from the day of conclusion of the contract.
  3. To exercise the right of withdrawal, the User must notify us of his decision to withdraw from the contract by means of an unequivocal statement (for example: a letter sent by post or e-mail). You may use the model withdrawal form below, although its use is not mandatory.
  4. In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiration of the withdrawal period.
  5. In the event of withdrawal by the User, the Holder shall refund all payments received without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract.
  6. The reimbursement will be made using the same means of payment used by the User.

6.4 According to Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November, in its art. 103, the right of withdrawal shall not apply to contracts relating to (among others):

  1. The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.

In relation to this section, with the User’s order, he/she gives his/her prior express consent, with the knowledge and acceptance on his/her part of the exceptions contained herein, and consequently in such cases, he/she loses his/her right of withdrawal.

  1. Returns

An order shall be considered delivered when the delivery receipt is signed by the User. The latter will have a period of 14 calendar days to make any return.

To be able to return the product, it must be in its original packaging and keep its labels, as well as be in the same condition as when it was sent.

If the User chooses to cancel all or part of the order, he/she will receive a refund of the corresponding amount as soon as possible, once all the requirements and obligations derived from such request have been certified.

These amounts will be paid to the user within a maximum period of 7 days after receipt of the order at the Holder’s facilities. Refunds of amounts paid will always be made by the same means of payment used by the User.

To make a return, the User must first contact us by writing an email to tienda@tiendavinosiberian.com, using the contact form or by calling the customer service number: 956854204 and will be sent the instructions and steps to follow.

  1. Availability

The Holder undertakes not to make available to Users an item that is not in stock except in the case of a computer error or any other imponderable situation. In the event of such unfortunate occurrence, the Holder undertakes to inform the User and reach a satisfactory agreement with him/her.

9. Customer Service

The User shall have at his disposal a Customer Service, for which he may use the contact form and will receive a reply as soon as possible (or he may use the telephone number 956854204 during business hours).

  1. Dispute resolution platform

Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 sets out the objective of achieving a high level of consumer protection and the proper functioning of the internal market, in particular its digital dimension, by providing a European online dispute resolution platform to facilitate the out-of-court resolution of disputes between consumers and online traders in an independent, impartial, transparent, efficient and fair manner.

For this purpose, this Web Site provides the User with a link that allows access to the European Union’s online dispute resolution platform, for any possible dispute that may arise in consumer matters: https://ec.europa.eu/consumers/odr/.
